Gayest State

The California Supreme Court ruled today that same-sex couples should be permitted to marry, rejecting state marriage laws as discriminatory.

The state high court's 4-3 ruling was unlikely to end the debate over gay matrimony in California. A group has circulated petitions for a November ballot initiative that would amend the state Constitution to block same-sex marriage, while the Legislature has twice passed bills to authorize gay marriage.

Fab-u-lous! California is now the gayest state in the Union. Yep gayer than Massachusetts. San Fran alone tips the scale.

  1. The decision of the California Supreme Court to ignore Proposition 22, which declares that “Only marriage between a man and a woman is valid or recognized in California," and was passed with a whopping 61 percent of the vote.

    I refuse to vote for any ballot measures in the State of California in the 2008 November election since the courts can simply nullify their votes whenever they want to.

  2. Hope I'm not wasting my breath here, but to clarify for Mr. Out...

    The California Supreme Court did not ignore Prop 22. In fact, their ruling was about Prop 22. Much like the Supreme Court of the United States, the California Supreme Court is charged with the responsibility of determining if laws are constitutional. In this case, they ruled that Prop 22 is unconstitutional based on the Equal Protection Clause of the California State Constitution.

    It should also be noted that the Supreme Court can not "nullify their votes whenever they want to". They didn't go looking for a law to overturn. The case was brought to them and they took it up at the urging of the Attorney General of the state.

    Debate the merits of same-sex marriage all you want, but the Supreme Court was merely fulfilling its obligation to the people of California.

    The solution, if you oppose the concept of equal rights for all citizens, is to amend the state Constitution. As clearly stated in Capn's post, this process is already under way. If the Constitution is successfully amended, then the state can go back to its old discriminatory ways.

    If you feel strongly inclined not to vote for any ballot measures in November, I strongly encourage you to sit this one out. The less people vote for this misguided amendment initiative, the better.

    Fortunately, California's Republican Governor has pledged to uphold the ruling and opposes any amendment that would overturn it.

  3. Wow, that's the most intelligent thing I've ever read on Blasphemes - except that Yoda and Luke were training according to the rules of a second generation roll-playing game, which factored in parsecs and whatnot.
